Pena Sues Meadowlands, Gural
By Bill Finley

Trainer Lou Pena, who has been barred from participating
at the Meadowlands, has filed suit in a federal court seeking
a temporary injunction that could force the track to allow
him to race.

I give him credit for trying.  Isn't this better than putting his stable under a "beard" trainer ?   I hope he gets the injunction.

While I don't think it is right that he got barred,considering others that are allowed to race, why didn't he do this at Yonkers than as well?

Not exactly true. Private entities have the right of exclusion, which has been confirmed by the courts many times, most notably in Crissman vs Dover Downs Entertaiment (around 2001-2002). But the right of Public entities to exclude is murkier.
He has sued Gural AND the NJSEA and the court will need to sort out the legal status of the NJSEA. Are they simply a landlord or something more? I think he will get the injunction at least until that issue is determined. Smart move by his attorneys.

I understand your point Giss, but I think Jeff would not have done this if he was going to get the short end. Maybe they will get injunction but he will come out the winner in the end.

Dover thought so too...and they were FAR more clearly arm's-length than Mr. Gural... and the Federal Court agreed, but the Appeals Court did not.

Many, many moons an IL trainer I knew had the "hot, undetectable stuff" of the day and nobody could beat him. It took a long time for the lab to figure out what it was, but they had frozen all his winning samples, so they nailed him on a ton of positives and gave him a lifetime ban. He hired F. Lee Bailey and got the lifetime ban dropped, but everytime he applied for a license the IRB would come with another reason to deny his application. He never did get back in. You do the crime, you do the time.

I don't think the Louie story is over yet.

forgot the guy's name but there is a Hispanic training horses at M1....so don't think that will fly either.
