court to issue his client a temporary
restraining order that, if

Prediction: This case will not end Pena's career. He will beat this like I used to get beaten as a young kid. I believe I could win the case for him and I never made it past college English.

Judges and racetrack executives are an equally unpredictable lot. When Pena was kicked out of Yonkers in early August, 2011 there were no positives involved and the track had very little to say about it. In late November Pena announced that they called him and said to come on back to work. No hard feelings. ????

My understanding is the guidelines dir administering medication are simply guidelines. No positive, no case....at least in my humble opinion.

My only point was that sometimes the judge hearing the case trumps the letter of the law. It's more of a crap shoot than it should be.

There are a ton of things going for Pena. I think this is a no brainer for his attorneys.
