Harnessracing.com has learned a hearing scheduled for Tuesday, April 23, between the Kentucky Horse Racing Commission and the connections of Odds On Equuleus, who was disqualfied from a first-place finish in an $85,800 Bluegrass division for 2-year-old colt pacers last September at The Red Mile, has been canceled.
Harnessracing.com was told by a commission official on Thursday that the hearing was canceled, and the information was confirmed Friday by Odds On Equuleus's trainer, Robin Schadt, who said the commission has told her that the disqualification was not appealable. The dq came into play when The Red Mile stewards deemed driver John Campbell guilty of causing interference while on the front end with Odds On Equuleus that he took hold abruptly and caused confusion to the trailing horses.
While Campbell at first was told by the stewards that he would not receive any sanctions for his alleged actions, following a hearing on Nov. 19 he was issued a $150 fine, which he subsequently appealed and is still awaiting a final decision.
The Nov. 19 ruling stated in part: "It is the decision of the judges that Mr. Campbell and the horse Odds On Equuleus did slow the pace of the race sufficiently to cause confusion among the trailing horses. It is the judge's opinion...that the horse and the driver are both at some fault for the interference."
Schadt, who shares ownership of Odds On Equuleus with Dana Parham as Odds On Racing, said their attorney is preparing a motion that will be filed in Circuit Court in Kentucky in an effort to resolve the matter.
