This was not a good day for Lou Pena in court. Bill Finley reports in Harness racing update that Judge Stanley Chesler was apparently singularly unimpressed with the arguments made by Pena

Thanks for the update

I saw nothing in his comments that showed him leaning one way or the other, other than his failure to immediately grant injunctive relief.
That's because your not an experienced attorney that was present in the court room when the announcement was made.
That "experience" allows an attorney to assume results based upon facial reactions and past practices.
The logic is the same when attorneys attempt to become horsemen ;)

And reporters? Where do they fit in? It was Bill Finley's words, not an attorney's that evaluated the judge's demeanor. At least Andy Cohen (who may not have been unbiased) is an attorney.

Thoughts why was the case regarding the jockeys in West Virginia not cited on behalf of Louie by his abogadoes ?

This was not a good day for Lou Pena in court.
Chesler refused to be rushed into granting an injunction, and his questions, comments and demeanor seemed to indicate that he believes Gural is within his rights to ban Pena.
I read it the same way. Poor, poor Lou. shootme

no state action.

I will be the first to admit I was wrong. A bit surprised that he did not grant the injunction on the possibility, but we move on.
As I have said, I agree with the private right of exclusion. The only question here was the state-private relationship.
