Even if you don't want to hear it..............
First of July an owner sends us a check......he's been sending us checks for over 15 years.........when he says his check is in the mail.....it is in the mail..........(unlike the tricks Gary and I can pull)
Anywho.......a week goes by........no check............to make a long story short, I contact Ed, he tells me what day he mailed it.......the security guard who picks up the tracks mail, goes thru her van and every one in the general office is asked if per chance it was sorted wrong and ended up on their desk.....nothing.
Ed sends us another check (got it in two days from Monroe, Michigan) and tells me to tear up the other one if it ever shows up.......he isn't going to stop payment on it.......not really worried.......and mind you, Ed is METICULOUS to a penny.......he owned a very successful car dealership in Michigan which exists to this day.
He doesn't bank on line.........received his statement yesterday.........guess what? Check was cashed.
They tell him at the bank he is going to have to wait to get a copy of the check on Monday. In the mean time he calls Buck and I, and I proceed to flip out..........let alone, at the time Buck and our daughter are racing two at Scioto and the boys and I have six in at Northfield and I'm finding out about this at 5:30pm.
Ed drives over to the branch to try and get better service.......and he does.......of course by the time he gets back home with it, I'm in the paddock, praying to God a horseman didn't steal it, or that I didn't lose my mind and deposit it!
The check went thru his bank August 1st..........it was mailed to me July 14th..........on the back is an endorsement stamp.....for deposit only, and I can't remember the exact company name but it had an INC. with a DBA, Haul-Away...deposited at a First Merit Bank in Bath Ohio.............about 20 miles from Northfield.
Haul-Away's address is Po Box 374 Richfield, Ohio.....Northfield Park's address is Po Box 374 Northfield Ohio......they are about 10 miles apart..............does anyone see where this is leading?
So..........Haul-Away received a check made out to Calvin Hollar, endorsed it, deposited it...............wouldn't you think First Merit or Ed's Monroe Bank and Trust would have some responsibility?
Well......after SEVERAL phone calls between Ed and I, and all the banks and he and I.......the answer is no............in fact, First Merit's security officer point blank told me, they will provide no more information and our issue is with Haul-Away (Which I understand they are ultimately responsible), because the bank is merely a "holder of the money".....it is not their responsibility to carefully look at who endorses the check or who it is made out too.
Of course there is no one in the office of Haul-Away today and I have to start this process over on Monday morning....................and I just PRAY they are not assholes. :-[
Ed and his wife Angie are in their 70s so I am trying to take care of this as much as possible on my own but Angie made a good point.........she said, how could they take and cash a check with out applying it to an account as payment? And if we don't have an account with Haul-Away and you don't have an account with Haul-Away, who's account was paid on? idunno idunno
I am still amazed by First Merit saying they are at no fault what so ever..........and it wasn't like I was looking to place blame..........I do think it was just a mistake but it sure would help if First Merit backed up the mistake when I contact Haul-Away on Monday! 4pezz2
Banks make SO much money off of people, it is sickening..........and then, this is how we are protected?
I'm not going to be able to relax over this until Ed gets his money back.............which it wasn't a huge amount, but it was enough!
Needless to say...............I'm looking forward to the horsemen's outing we have planned tomorrow and a couple tall gin and tonics tonight.

You got to be kidding me. I guantee if I cashed someone's check that was not mine , My ass would be grass. Certainly it was endorsed and deposited by mistake at Haul Away..........? 4pezz2

Amy Haul Away may not do their own accounting. Therefore they wouldn't necessarily be putting it against an accounts payable account. However I doubt they get that many checks that they wouldn't be seeing someone else's name one it.

Oh I think it was........I really don't think there was any malicious intent.......and neither does Ed........which he is grateful for, because the thought of getting police involved was not pleasant, and like he said, if it was stolen, there is probably no way he'd get the money back.
But, if I would cash someone else's check? I have a feeling there would be handcuffs involved.

Now we need the rest of the story. How many checks had you written against Ed's check before it was supposed to get to you? If your stable is like mine was, it was all gone before you got it and everyone was admonished to hold the check you gave them until you say it's ok to cash it.

I know that cashing someone elses check is indeed a crime.
And people do go to jail for it.

Check is in the mail is so old fashion. If the "check" was sent on-line it would go right from the sender's account into yours. No envelopes, no prying hands and eyes.
In another matter, I got a check from my medical group yesterday for an overpayment I made in 2008!
Banks charge you for every mistake you make. When they make a mistake, tough toenails.
In the final analysis, I agree that it must be Bush's fault That A-hole is also responsible for my losing at Balmoral tonight. When Gov. Quinn vetoes that slots at the tracks bill on Tuesday, that also will be Bush's fault. I can't think of one thing that is bad that isn't Bush's fault.

An ATM ate over 500 bucks on me, it took me over 9 weeks to get the cash back. Lesson learned - always use a bank ATM never one of those white no name ATM. Bright side of the weekend Amy.....you had two 2nds last night and your horses and barn look amazing!!! Keep it up :o)

I remember when hardly anyone had a checking account or a credit card! I'm sure he does too. Now hardly anyone uses a check anymore. ATMs also didn't exist.if you needed cash after the banks closed at noon Saturday, you had to wait until Monday.

First to the Bath, Ohio Police Department. second to Cheryl Harris, consumer reporter at the Plain Dealer and her counterpart at the Akron Beacon urinal. Next to a local TV station. Pick one, anyone and ask for their consumer reporter.
Afterwards, contact First Merit and let them know that they can be expecting calls from those individuals and that you trust the matter will be taken care of in within the next business day.
(I am guessing that you personally do not bank at First Merit?)

One phone call to the police dept should resolve it quickly. Like someone said earlier if an ordinary person rather than a business had cashed that check they could probably be charged with some crime. The same should hold true for a business - or at least you would think so.

Excuse me? I work my fingers to the bone for the better part of 10 months per year, slaving over bets of up to $25,000, plus a $2500 bet for the dealers if the player loves Jesus enough. I am under constant bombardment by drunks, by women wanting a piece of Luther D., in addition to serving on the toke committee much of the time, protecting my bosses like Pope when they get rude, and giving massages to the beautiful Asian co-workers on my breaks.
I am a working stiff....at least on many of my breaks. dorkusinterruptus

Like I said, Ed called us Friday around 5pm.........I was on the phone as long as I could and back on it Saturday morning............I just hope I have extra time tomorrow.......I mean, it is going to be busy with 18 head to swing on and a grand meal to plan for my father to eat during the races tomorrow night because my Ma refuse to feed him any more..............

Update.........7:30 am I started calling, Haul-Away.......finally talked to a person at 10:15am......in the mean time I had left two messages, one a voice machine being as detailed as possible...........man at 10:15 told me he just got in, would fire up the computers and get back to me in 15 minutes.
12:30pm.........no call......I call him........poor fella is having a hectic Monday morning.......he is in touch with First Merit bank and can see where the deposit was made and he apologizes and as soon as he verifies the information with the bank he will get back to me.............it's now 2:05............I'm in cranky-need-a-nap-mode..........I have a pretty good feeling if I had taken one of their checks........my hectic ass would be in jail by now.

Yeah, I think I would have called the police first rather than the company. Might have gotten resolved much faster.

Ole FreeLegged casually put one of his size 11 PF Flyers right over the top of it and just stood there. Looked around to be sure nobody else witnessed it and as the old lady left I just grabbed that puppy and put it in my pocket. Thats a full meal for me next time Batavia Downs has that hot dog promotion.
I feel comfortable in saying that you will get your money back, Amy. This poor old lady in the convenience store will not, however. thumbsup

Monroe Bank and Trust have told Ed it could take 30 to 45 days. But they are handling the situation right now.
All I know...........Haul-Away in Richfield Ohio deserves their "F" rating for not making this a top priority on Monday and refusing to answer my calls...............which I was extremely polite about........maybe to a fault.

If you can't stomach feeling like a bad guy I will do it for you. I actually enjoy it from time to time, especially towards assholes who deserve it. But if his bank reimburses it for you (seems like a small bank compared to first merit) they might end up being out of the money (as well as spending time and payroll to do it) and it wouldn't be fair for them either.

I am a bit surprised at my eldest daughter's restaint. I'd called every news station 1st and then I'd 2nd I'd left them a nice message on thier answering maching that "My close friend "Bubba" enjoys the sound of human bones breaking and He'll be seeing you all real thumbsdown hammerhead1soon"

I'm just respecting what Ed wants to do......he has already paid us with another check (which arrived in two days).........so technically they owe him, not me.
With the amount of business he has done over the years with his hometown bank, I'm sure they are being very aggressive.
In the mean time, if the opportunity arises, I've pretty well voiced an opinion on what I think of Haul-Away.........and it isn't favorable.
Jeremy, I may sic you on the neighbors dog which enjoys barking at 6:30am.......and while I am awake, it is still pretty annoying.
